What’s Protected Under Charlotte’s Tree Ordinance?

• Heritage Trees – Native trees with trunks 30 inches or larger in diameter.
• Street Trees – Trees planted in the right-of-way (typically between the sidewalk and street).
• Trees on Development Sites – Tree-save and canopy coverage requirements apply.

Before removing a tree, you may need to get a tree removal permit, especially if the tree is protected. In many cases, you’ll also need to replant new trees or pay a mitigation fee to stay in compliance with the city’s Unified Development Ordinance (UDO).

Even dead or hazardous trees may still require documentation before removal.

Permits may be required for:

• Tree removal
• Tree trimming or pruning
• Soil disturbance within the tree’s root zone (like digging, grading, or trenching)

Removing or working around protected trees without approval can lead to fines—sometimes up to $200 per inch of trunk removed—and may also require you to plant replacement trees or pay a mitigation fee.
